Paw's Rescue — Terms & Conditions

Please read these Terms & Conditions ("Terms") carefully. They include important information about your legal rights, including warranty disclaimers, a limitation of liability, and an indemnification obligation. By visiting or using the Paw's Rescue website (the "Site" or "Services"), placing an order, or enrolling in a membership, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Who We Are
Paw's Rescue ("Paw's Rescue," "we," "us," or "our") is a for-profit business. We are not a 501(c)(3) charity, non-profit, or tax-exempt organization. Amounts you pay are for products and/or memberships — they are not charitable donations and are not tax-deductible. Any references to "giving," "donating," "feeding," "helping," "rescue," or "mission" describe a commercial commitment by Paw's Rescue (Section 3), not a donation by you, and do not change the for-profit nature of your purchase.
2. Access & Account
You represent that you are at least 18 (or the age of majority in your jurisdiction). You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account to anyone else.
3. Our Giving Commitment
Under a standing agreement with our feeding partner(s): for each eligible item purchased, Paw's Rescue funds the equivalent of ten (10) meals for dogs in need; and for each active monthly membership, Paw's Rescue funds the equivalent of thirty (30) meals per month for dogs in need. Optional checkout add-ons (such as the $9 puppy-support add-on) fund the equivalent of an additional ten (10) meals, plus basic comfort items where available, for puppies and dogs in our care. Meals are provided and distributed through our feeding partner(s). Paw's Rescue — not the customer — makes these contributions as part of its business. We do not represent that any specific portion of your individual purchase is passed to a charity, that your purchase is tax-deductible, or that you are personally making a donation.
4. Our Products
We make every effort to represent products accurately, but colors and appearance may differ on your device. We do not warrant that the appearance or quality of any product will meet your expectations or match how it appears online. Product descriptions may change at any time without notice, and we may discontinue products or limit quantities by person, region, or jurisdiction at our sole discretion.
5. Orders
When you place an order you are making an offer to purchase. We may accept or decline any order for any reason, and your order is not accepted until we confirm it and process payment. We may be unable to accommodate cancellations after acceptance. You represent that your purchases are for your own personal or household use and not for commercial resale or export.
6. Pricing, Billing & "Free + Shipping" Offers
Prices are in U.S. dollars and may change without notice; the price charged is the price in effect when the order is placed and shown in your confirmation. Posted prices exclude taxes, shipping, handling, and any customs charges unless stated. Promotional, "free," or "free + shipping" offers are limited-time and subject to availability; where an item is offered free, applicable shipping and handling still apply and are disclosed before you complete your order. You represent and warrant that your payment information is true and complete, that you are authorized to use the payment method, and that you will pay all charges incurred at posted prices, including shipping, taxes, selected add-ons, and any recurring membership charges you have agreed to.
7. Memberships, Auto-Renewal & Cancellation
Certain offers enroll you in a recurring membership (the "Hero VIP membership" or similar). By enrolling, you authorize recurring charges. This is an automatically renewing subscription — please read carefully.
- Introductory period: 10 days from enrollment.
- Recurring charge: $29.99, billed every 28 days after the introductory period, automatically, until you cancel.
- Member benefits: as described to you at the time of enrollment.
- Cancellation: you may cancel at any time through your account, the cancellation request form on the Site, or by emailing support@rescupaws.com. To avoid the next charge, cancel at least 3 days before your next billing date. Cancellation stops future charges.
- You consent to electronic delivery of membership and billing communications, including any renewal reminders required by law.
8. Shipping & Delivery
We are not liable for shipping or delivery delays. Delivery times are estimates only and are not guaranteed, including delays caused by carriers, customs, or events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you.
9. Returns & Refunds
All sales are final. Except where required by applicable law, all purchases are non-refundable, including shipping and handling. For memberships, you may cancel at any time to stop future charges; membership fees already billed are non-refundable. We honor the policy stated at the time of purchase.
10. Errors, Inaccuracies & Omissions
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change, update, or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.
11. Customer Reviews, Testimonials & Feedback
Testimonials and reviews reflect individual experiences and are not a guarantee of results. Endorsements comply with the FTC Endorsement Guides, and any compensation or incentive for a review is disclosed. If you submit feedback, reviews, ideas, or other content, you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display it for any purpose, including commercial use, and you represent you have all rights to it. We have no obligation to keep feedback confidential, to pay for it, or to display it, and may remove content we find objectionable.
12. Intellectual Property
The Services — including trademarks, brand names, text, images, graphics, video, audio, and their selection and arrangement — are owned by Paw's Rescue or its licensors and protected by intellectual-property laws. You may use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, republish, or transmit any material without our prior written consent. All rights not expressly granted are reserved.
13. Third-Party Tools & Links
We may provide access to third-party tools and links we neither monitor nor control, offered "as is" and "as available" without warranties. Your use of them is at your own risk and subject to the third party's terms. We are not responsible or liable for any third-party site, tool, product, or content; direct any complaints to the third party.
14. Prohibited Uses
You may use the Services only for lawful purposes. You may not use them to violate any law or intellectual-property rights; to transmit false or misleading information; to harass, abuse, defame, or harm any person; to send spam or solicitations; to impersonate any person or entity; to upload viruses or malicious code; to scrape, crawl, or harvest data; to resell or exploit any part of the Services; or to interfere with or circumvent security features. We may suspend, disable, or terminate your access at any time, without notice, for any violation.
15. Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED BY PAW'S RESCUE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT FULLY APPLY TO YOU.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL PAW'S RESCUE OR ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR MEMBERSHIP GIVING RISE TO THE CLAIM.
17. Indemnification
You agree to indemnify, defend, and hold harmless Paw's Rescue and its owners, affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of (1) your breach of these Terms, (2) your violation of any law or third-party right, or (3) your access to or use of the Services.
18. Termination & Survival
We may terminate this agreement or your access to the Services at our sole discretion at any time without notice, and you remain liable for all amounts due through termination. Sections that by their nature should survive — including Giving Commitment, Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and these survival terms — continue after termination.
19. Relationship With Shopify
Paw's Rescue is powered by Shopify, but all sales are made directly with Paw's Rescue. Shopify is not responsible for any aspect of any sale, including any injury, damage, or loss from purchased products or services, and you release Shopify and its affiliates from all claims arising from your purchases with Paw's Rescue.
20. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules, and you consent to venue and personal jurisdiction in the state and federal courts located there.
21. Assignment
You may not assign or transfer these Terms or your rights without our prior written consent; any attempt is void. We may assign or transfer these Terms and our rights and obligations without your consent or notice.
22. Severability; Waiver; Entire Agreement
If any provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will stay in effect. Our failure to enforce any provision is not a waiver. These Terms, together with policies posted on the Site, are the entire agreement between you and us and supersede prior agreements. Headings are for convenience only.
23. Changes to These Terms
We may update these Terms at any time by posting the updated version with a new "Last updated" date. Continued use after changes constitutes acceptance.
